Pre-Information Form

Article 1 — Subject

The subject of this Pre-Information Form is to inform the Buyer, pursuant to Consumer Protection Law No. 6502 and the Distance Contracts Regulation dated 29.11.2014 No. 29188, about the wholesale sale and delivery of women's clothing products ordered through www.sophisticwoman.com. By approving the form, the Buyer accepts, declares, and undertakes that they have received accurate and complete information about the Seller, product features, sales price including taxes, and payment and delivery details.

Article 4 — Basic Features of the Product and Payment Information

The product type, quantity, color, size, unit price, and total amount are presented to the Buyer on the order summary screen and in the confirmation email.

Article 5 — Delivery Information

• —If there is no courier branch at the delivery address, the Buyer collects from the nearest branch.
• —The Seller assumes no responsibility if the Buyer is not present at the address during delivery.
• —If out of stock, the Seller notifies the Buyer within 3 business days and refunds within 14 days.

Article 7 — Rights and Obligations of the Parties

Article 8 — Right of Withdrawal

The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receiving the goods, without giving any reason and without paying a penalty. The right of withdrawal may also be exercised during the period from contract formation to delivery.

• —After the withdrawal notice, the product is shipped within 10 days.
• —The Seller refunds the payment within 14 days of receiving the product.
• —Shipping costs under the right of withdrawal are borne by the Buyer.

Article 9 — Cases Where the Right of Withdrawal Cannot Be Used

Pursuant to Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be used in the following cases:

• —Products prepared upon the Buyer's request with custom production/printing
• —Products whose packaging has been opened, used, or washed
• —Underwear products whose return is inappropriate for hygiene reasons
• —Products mixed with other products that cannot be separated
• —Products whose price depends on fluctuations in financial markets

Article 10 — Return Conditions

• —Return requests must be notified in writing within 14 days of delivery.
• —Products to be returned must have their original tags, be unused, and be in original packaging.
• —For corporate-invoiced orders, a return invoice is mandatory; VAT refund cannot be made without an invoice.
• —Shipping costs are borne by the Seller for errors attributable to the Seller.
• —Shipping costs for other returns are borne by the Buyer.
• —For damaged or defective products, photographic notification must be made within 2 business days of delivery.

Article 11 — Personal Data Protection

The Buyer's personal data is processed within the scope of KVKK Law No. 6698 and in accordance with the Privacy Notice published at www.sophisticwoman.com/kvkk. Personal data is used only for the purpose of fulfilling orders, delivery, and legal obligations.

Article 12 — Competent Court and Dispute Resolution

• —Consumer Arbitration Committee: Within the monetary limits determined by the Ministry of Commerce of the Republic of Turkey, the committee at the Buyer's place of residence may be applied to.
• —Consumer Court: For disputes exceeding the monetary limit, the consumer court at the Buyer's place of residence may be applied to.
• —For commercial purchases: Istanbul (Güngören) Courts and Enforcement Offices are competent.

After this Pre-Information Form is read and accepted by the Buyer in electronic form, the Distance Sales Contract will be established. The form and related documents will be retained by the Seller for 3 years.
